The Corporate Counsel, Patent Litigation will be responsible for supporting patent litigation matters in the U.S. and abroad, including Hatch-Waxman matters, Inter Partes Reviews (IPRs), and similar foreign proceedings. Working in partnership with outside counsel and other in-house attorneys and staff, the position will develop and drive case strategies as an active team member. Counsel will assist with day-to-day tasks associated with case management, discovery, assisting with interviewing witnesses, collaborating with outside counsel to prepare witnesses for depositions and trial, attending fact and expert depositions, and collaborating with internal and outside counsel to select experts and to prepare expert testimony. This position reports to the VP, Litigation. The ideal candidate will have both law firm and inhouse experience, experience with pharmaceutical patents, and strong interpersonal skills. Must be able to work with limited day-to-day supervision and be able to make decisions independently when necessary, all while maintaining confidentiality.
Responsibilities include, but are not limited to:
Actively participating in management of patent litigation. This includes assisting with day-to-day tasks associated with case management, assisting with interviewing fact and expert witnesses, and collaborating with outside counsel and internal counsel in the development of strategies and arguments.
Assisting in internal document collection and production, including working with the internal e-discovery team.
Reviewing correspondence, arguments, memos, and briefs in support of litigation.
Assisting in providing instruction to foreign litigation counsel and in the day-to-day tasks associated with multi-jurisdictional litigation teams.
Assisting in evaluating the company’s patent portfolio in advance of litigation and other activities designed to maximize the strength of the IP assets.
Collaborating with other IP department professionals to secure and assert the company’s patents world-wide.
Juris Doctorate and admission to at least one U.S. State Bar and the Patent Bar.
Minimum 3 years of relevant experience with a law firm.
Bachelor’s degree or higher in biology, chemistry, pharmacy or other related life-sciences.
Preference is given to individuals with in house experience.
Preference is given to individuals having experience in pharmaceutical and/or biotechnology patent litigation.
